The cyberattack occurred in November 2020 but was not publicly disclosed until March 2021. The action alleges that Automation Personnel failed to have requisite cybersecurity to prevent the breach that left personal data vulnerable to exploitation. The company denies all wrongdoing, but it settles to put these allegations to rest without further litigation.
It has a settlement concerning those whose personal information was compromised in that breach. Compensation will be available to all affected with credit monitoring services as well. Claims of $5000 may be made by reimbursing direct expenses that occur as a result of the breach, such as bank fees, credit monitoring, and fraudulent charges. Class members who incurred time loss due to the breach may also present a claim for compensation for up to four hours at a rate of $20 per hour.
There is also one year free of credit monitoring services through Identity Theft Guard Solutions as part of the settlement. Therefore, this is an assurance of protection to those exposed by the incident.
How to file a claim and key deadlines
Eligible individuals must hurry to enjoy the benefits of the settlement. To be part of this, a claim form must be sent by the 24th of December, 2004, together with other supporting documentation receipts, bank statements, or other evidence of losses related to the breach. Without this form, the affected individuals cannot recover any compensation.
A final approval hearing will take place for the settlement on the 6th of February, 2025, where the court will determine whether final approval is granted or not. Meanwhile, class members can start gathering the necessary documentation as well as completing their claim forms.
